21-22 Season Pass Liability Waiver

Please read the waiver below and fill out the required fields found in the following form sections. All liability language from the waiver will apply to all persons listed below.

MT. SPOKANE SKI & SNOWBOARD PARK SEASON PASS CONTRACT & LIABILITY RELEASE 

SEASON DATES: Opening Day November 2021 – Closing Day April 2022 (the “Season”)

1. I am the Passholder listed above, and, as part of the consideration for the issuance of the Season Pass from Mt. Spokane Ski and Snowboard Park (“Mt. Spokane”), I understand and agree to each of the following parts of this Season Pass Contract and Liability Release (“Contract”):My Season Pass is non-transferable and non-refundable for any reason. Mt. SPOKANE WILL NOT REFUND OR ROLLOVER PASSES FOR ANY REASON. This means that no refunds will be given once the Season Pass is purchased, even if it is never used. The ONLY exception is if the Pass Refund Protection Insurance has been purchased prior to the deadline. 

2. My Season Pass must be worn, or be in my possession, at all times when I ride/ski at Mt. Spokane and must be presented at each lift before boarding.

3. I will NOT share or allow another person to use my Season Pass under any circumstances or conditions.  Sharing of my Season Pass may result in suspension or revocation of my Season Pass, without refund, any may result in the inability to purchase any future season pass and/or lift tickets for both me and the person caught using my Season Pass.

4. If my Season Pass is lost or stolen, I must promptly report it to the Ticket Office so that my Season Pass can be deactivated and a new pass issued.  

5. My Season Pass is valid any day Mt. Spokane is open for skiing/riding during the Season.  Mt. Spokane may vary the length of the Season, operating hours, as well as determine the number of lifts in operation and terrain available and/or groomed for use at any given time.  Mt. Spokane cannot guarantee the quality of the skiing conditions. No refund or compensation will be given for any item listed in this section, including park closure, lift closure, or ski conditions.

6. As a Season Pass holder, I remain subject to all of the policies and rules of Mt. Spokane, including the Skiers and Snowboarder’s Responsibility Code which provides:

Ski or snowboard under control and in such a manner you can stop or avoid others or objects.
People ahead of you have the right of way, it is your responsibility to avoid them.
You must not stop where you obstruct a trail or are not visible from above.
When entering a trail or starting downhill, yield to others.
Use retention straps or devices to help prevent runaway equipment.
You shall keep off closed trails and out of posted areas.
Observe all posted signs.
Inverted aerials are not recommended
Prior to using any lift, you must have the knowledge and ability to load, ride and unload safely.

This is a partial list. Be safety conscious.

7. I understand that the laws of Washington State apply to my use of Mt. Spokane, which laws include:

  • All skiers [or snowboarders] shall conduct themselves within the limits of their individual ability and shall not act in a manner that may contribute to the injury of themselves or any other person.
  • No skier [or snowboarder] may willfully engage in any type of conduct which may injure any person, or place any object in the uphill ski track which may cause another to fall, while traveling uphill on a ski lift.
  • Every person shall maintain control of [their] speed and course at all times, and shall stay clear of any snow grooming equipment, any vehicle, any lift tower, and any other equipment on the mountain.
  • All person sshall be the sole judge of their ability to negotiate any trail, run, or uphill track.
  • All persons using the ski hill shall exercise reasonable care for their own safety.
  • All persons on foot or on any sliding device have a duty to avoid collisions.

It is prohibited to:

  • leave the scene of an accident without obtaining assistance or notifying authorities.
  • Ski or snowboard in in closed area or outside ski boundaries
  • Ride a closed lift or interfere with the safe operation of a lift
  • Load or unload a lift other than at designated crossings
  • Throw or trop anything from a lift, including littering
  • Failure to follow a verbal or written instruction for lift use, skiing or snowboarding near towers, equipment, vehicles and other obstacles. RCW 79A.45

8. Mt. Spokane has the right to use any photos of me taken by the Mt. Spokane staff or their agents in any media of their choosing.

9. Mt. Spokane retains the right to suspend or permanently revoke my Season Pass if I breach this Contract, disregard Mt. Spokane policies, disregard the directions given me by authorized Mt. Spokane personnel, disregard posted signage, or otherwise behave in a way that is unsafe, including disregarding the safe use of lifts, terrain or other facilities, riding/skiing in a reckless manner or at excessive speeds, skiing or snowboarding outside the ski area boundary or skiing after Ski Patrol have started Trail Closing Procedures (TCP).

10. If I am injured while skiing or riding on closed terrain and I am rescued, I agree to pay for all costs of my rescue, including time, materials and any injuries sustained by any rescuer.  

11. I understand that I am not eligible for a Season Pass unless I sign the Injury Waiver and Liability Release that is a part of this Contract.

12. This is the entire agreement relating to the subject matter of this Contract. This Contract can only be amended by a written agreement signed by both parties.  No failure by Mt. Spokane to enforce its rights constitutes a waiver of such right.  Where the Contract has a list that includes certain items, the listed items are not exclusive. This Contract is subject to the laws of the State of Washington, without giving effect to conflict of interest rules.  If this Contract is signed electronically, the electronic signature will qualify as a writing.  This Contract is binding upon all successors.

13. If the Season Pass holder is under the age of 18, this Contract must be signed by the parent or legal guardian of the minor.  By signing on behalf of a minor, the parent or guardian asserts their inherent rights as parents/guardians to make decisions for children. If the Season Pass holder turns 18 during the Season, their use of the Season Pass is considered a reaffirmation of this Contract under their own signature. 

I understand and agree that skiing and snowboarding are hazardous sports and that the risks of injury to property or persons resulting from any of the inherent dangers and risks of skiing and snowboarding rest with me, the skier/snowboarder.  Inherent dangers and risks of skiing/snowboarding include: 

  • failure to ski/snowboard within my own ability; changing weather conditions; 
  • existing and changing snow conditions; 
  • collisions with natural and man-made objects or other people at Mt. Spokane; 
  • bare spots; 
  • variations in snow; ice; 
  • unpredictable terrain; 
  • bumps; 
  • moguls; 
  • stumps; 
  • forest growth; 
  • debris; 
  • rocks; 
  • utility lines and poles; 
  • snowmaking equipment including pipes, hydrants, snow guns, hoses and other components; 
  • fences or the absence of fences; and 
  • other hazards or obstacles that exist within Mt. Spokane Ski Area. 

I also understand that avalanches and snow slides may occur in ski areas, both inside and outside the posted boundaries and that avalanches are an inherent risk of skiing/snowboarding due to the nature of snow.  In being present at Mt. Spokane and/or using the Season Pass I acknowledge, accept and assume these risks and all other risks (whether marked or unmarked) that can and do exist in the skiing.I have read and fully understood everything in this Contract, including the assumption of the risk.

In consideration of being allowed to voluntarily participate and use the facilities of Mt. Spokane, I agree that I will not sue Mt. Spokane 2000, which operates Mt. Spokane and, for the purposes of this Contract includes its owners, officers, directors, agents, or employees) and will release Mt. Spokane 2000, Inc. from any and all loss, liability, damage or costs of any kind that may occur as a result of any injury to myself or any person for who I am singing this Contract, , even if I contend that such injuries are the result of negligence, recklessness or any other improper conduct on the part of Mt. Spokane 2000, Inc.  

The undersigned hereby RELEASES AND HOLDS HARMLESS, Mt. Spokane 2000, Inc. and the Washington State Park and Recreation Commission, and its owners, agents and employees from any and all claims and liability for injury, loss, or damages resulting from the undersigned’s presence at Mt. Spokane and/or the use of Mr. Spokane’s facilities, slopes, and lifts.
